pixsolo Terms of Service

Welcome to the pixsolo image-design SaaS platform (hereinafter "pixsolo" or "the Platform"). Before you access or use any digital infrastructure service and AI tool provided by the Platform (collectively, the "Service"), please be sure to read and fully understand these Terms of Service (hereinafter "these Terms").

Once you access, register, log in to, or use the Service in any manner, you confirm that you have read, understood, and agreed to be bound by all the contents of these Terms. If you do not agree with any part of these Terms, please stop using and exit the Platform immediately.

1. Contracting Parties and Effectiveness of the Agreement

These Terms are jointly concluded between the actual operating entity of pixsolo — Shenzhen Weizhijiedian Technology Co., Ltd. (hereinafter "we" or "us") — and the premium end users who register, log in to, access, or use the pixsolo Service (hereinafter "you" or "the user"). These Terms constitute a legally binding formal agreement between the two parties.

Access to and use of the Service are also subject to the Privacy Policy, product page descriptions, and platform rules that we publish from time to time. The foregoing documents all constitute an inseparable part of the complete agreement and have the same legal effect as these Terms.

2. Revision and Modification of the Terms

In order to continuously optimize the user experience and ensure the security and compliance of the Platform, we reserve the right to revise these Terms from time to time in response to business development, technical upgrades, or changes in global legal compliance requirements.

In the event of a material change to these Terms, we will notify you by reasonable means, such as posting an announcement in a prominent position on the Platform or sending a notice to the email bound to your account. The revised Terms take effect from the "Last updated" date shown on the page. Your continued use of the pixsolo Service after the Terms change is deemed to constitute your full acceptance of and agreement to the revised Terms. If you do not agree with the changed contents, you must immediately stop using the Platform's services.

3. Account Registration, Security, and Cancellation

3.1 Account Registration Requirements

To unlock and use the premium image-design features, AI tools, and related digital infrastructure services of the pixsolo platform, you need to register and log in to a pixsolo account through legitimate channels. You undertake to provide true, accurate, complete, and up-to-date personal information at the time of registration, and you are responsible for updating such information in a timely manner to keep it valid.

3.2 Capacity and Eligibility

You confirm and warrant that, at the time of registering for and using the Service, you are at least 18 years old (or have reached the age of full civil capacity stipulated in your jurisdiction) and have full civil rights capacity and civil conduct capacity. The Service is not open to minors. If any account is found to violate this provision, we have the right to close or restrict it at any time without notice.

3.3 Account Security and Responsibility

You must properly safeguard your account credentials (including but not limited to login password, verification codes, etc.) and bear full legal responsibility for all activities conducted through your account, such as asset consumption, AI image generation, and data publishing. You may not provide your account to any third party by way of transfer, lending, leasing, or sale. We bear no responsibility for losses caused by account leakage, data loss, or hacker attacks resulting from causes not attributable to the Platform.

3.4 Account Suspension and Termination

If you violate any provision of these Terms, infringe the lawful rights and interests of third parties, disrupt the normal operation of the Platform, or violate applicable laws and regulations, we have the right to independently determine and take measures to restrict, suspend, or even permanently cancel your account at any time, without bearing any liability for compensation. Subject to compliance with legal requirements, if you wish to cancel your account, you may apply for deletion through the "Feedback & Suggestions" channel provided by the Platform or by contacting us directly.

4. User Conduct Standards and Prohibited Activities

4.1 Prohibited Uses

In the course of using pixsolo for image design and using AI tools, you must comply with the laws and regulations applicable in the relevant jurisdiction. You undertake never to use the Service to engage in any of the following activities:

1. Generating, disseminating, uploading, or sharing any content that is false, defamatory, insulting, harassing, threatening, infringing on others' privacy, or infringing on third-party intellectual property rights (such as copyright, trademark, or patent rights);
2. Designing, generating, or disseminating content that is pornographic, gambling-related, violent, or gory, or that incites discrimination based on class, ethnicity, gender, or religion;
3. Using the Service to directly or indirectly exploit, harm, induce, or attempt to harm minors;
4. Using the AI output generated by the Platform in high-risk automated decision-making processes such as judicial administration, law-enforcement investigation, medical diagnostic advice, financial credit approval, or any process that may have a material adverse impact on the lawful rights and interests of specific individuals;
5. Any other act that violates globally recognized public order, good morals, or the prohibitive provisions of relevant laws and regulations.

4.2 Technical and Operational Restrictions

You agree not to engage in any technical conduct that undermines the integrity and security of the pixsolo system, including but not limited to:

• Performing reverse engineering, decompilation, or disassembly of the Platform system, AI interfaces, or image-generation algorithms, or attempting to crack or obtain the source code;
• Using any unauthorized bot, web spider, scraper, or other automated means to extract or collect data, images, or core assets on the Platform in bulk;
• Uploading, embedding, or disseminating any file containing malicious code such as viruses, ransomware, or Trojan horses, or deliberately overloading the servers through means such as concurrent attacks or denial-of-service attacks.

5. Content Ownership and Intellectual Property

5.1 Ownership of Images and Content

The intellectual property and ownership of the input materials ("Input") that you submit to the Platform to assist with design, for image-to-image, or as prompts, remain yours. Provided that you comply with these Terms and all applicable laws, as between you and us, the rights and interests in the final images, posters, design drawings, and other output results ("Output") generated by pixsolo's AI tools and design services in response to your Input belong to you. You must ensure on your own the legality and compliance of the foregoing "Input" and "Output."

5.2 License Granted to the Platform

In order to safeguard the normal operation of the pixsolo Service, maintain the digital infrastructure, carry out system iteration and optimization, and guard against security risks, you hereby grant us a worldwide, royalty-free, non-exclusive, transferable, and sublicensable lawful right, allowing us, to the minimum extent permitted by applicable law, to reproduce, store, display, modify, and use the Input you upload and the Output generated. This license does not change the ownership attributes of the content.

5.3 Reporting of Image Infringement

We strictly respect and protect intellectual property. If you believe that any content on the pixsolo platform, or any Output that others have generated using the Platform, infringes your lawful copyright or rights, please submit to us a written infringement notice containing proof of ownership, the infringing link, and preliminary evidence, through the official contact methods specified in Article 10 of these Terms. We will promptly verify and handle the matter in accordance with the law within a reasonable period.

6. Paid Subscriptions, Billing, and Service Changes

6.1 Pricing and Subscription Tiers

pixsolo is paid premium image-design and AI-tool SaaS software. For different design needs, we offer four clear, one-time-payment subscription packages of digital infrastructure services and AI tools, namely: STARTER, BASIC, PRO, and ULTIMATE.

The detailed scope of entitlements, included AI generation quota, level of technical support, and specific pricing of each tier are subject to the latest content displayed on the corresponding purchase page of the Platform. You are responsible for fully understanding and confirming the relevant service details before clicking to purchase.

6.2 Nature of One-Time-Payment Goods

Please note in particular that all subscription products offered by pixsolo (STARTER, BASIC, PRO, ULTIMATE) are one-time-payment goods (a one-off buyout, or a per-transaction top-up purchase of a specific quota/period). The Platform has no auto-renewal; charges occur only when you actively initiate and complete the payment. We will activate the corresponding tier of service permissions for you only after you have paid the fee in full and the settlement is complete.

6.3 Payment Channels and Taxes

To provide convenience for users worldwide, we support the following secure third-party payment channels:

1. Alipay (支付宝)
2. Lemon Squeezy

All payment processing is subject to the independent service agreements and privacy terms of the aforementioned third-party payment platforms. Unless otherwise stated on the purchase page, the subscription price displayed may not include value-added tax (VAT), sales tax, or other statutory taxes and fees required by the laws of your jurisdiction; such taxes and fees will be withheld and paid on your behalf by the payment channel in accordance with regulations. For refunds and other financial-return policies, please refer in detail to the separate pixsolo Refund Policy.

6.4 Right to Adjust the Service

We reserve the right to optimize, upgrade, or adjust the functional assets corresponding to each subscription tier, or to modify the service pricing, at our own discretion at any time, in light of the market environment, technological innovation, compute-cost adjustments, and overall business strategy. The foregoing adjustments will not affect the existing entitlements you have already obtained through a successful one-time payment before the change takes effect.

7. Disclaimer and Limited Warranty

All image-design software services, AI tools, and digital infrastructure provided by the Platform are provided on an "As-Is" and "As-Available" basis, based on the current state of the technology, to the extent permitted by law. We make no express or implied warranty as to the suitability, continuity, error-freeness, timeliness, or security of the Service.

You fully acknowledge and agree that: AI image generation is a cutting-edge, exploratory technology, and the output it produces is affected by algorithms, compute power, and prompts; the Platform cannot guarantee its absolute accuracy, completeness, legality, or freedom from defects for commercial use. We do not bear joint and several liability for compensation for temporary service interruptions or data loss caused by network fluctuations, data-center failures, compute-power adjustments, hacker attacks, or force majeure; you should be responsible for the local backup of your everyday design assets yourself.

8. Limitation of Liability and Compensation Cap

To the maximum extent permitted by applicable law, the Platform's operating entity and its affiliates shall not bear any civil liability for compensation for any indirect, incidental, special, consequential, or punitive damages (including but not limited to loss of profits, damage to business reputation, data loss, or business interruption) caused by your use of or inability to use the pixsolo Service.

In any event, our total, cumulative maximum liability to you for compensation under these Terms or arising from the use of the pixsolo Service shall be limited to the total cumulative fees actually paid by you to us for purchasing pixsolo subscription products within the twelve (12) months preceding the date on which the claim is raised.

9. Dispute Resolution and Governing Law

The formation, effectiveness, performance, and interpretation of these Terms, and any form of dispute arising from these Terms or from the use of the Platform's services, shall be governed by and construed in accordance with applicable laws and regulations (including but not limited to the laws of the place where the operating entity is located, the place where the user is located, and relevant jurisdictions such as the United States of America), without applying its conflict-of-law rules.

The parties shall first resolve disputes through friendly negotiation in good faith; if negotiation fails within thirty (30) days from the date the dispute arises, either party has the right to submit the dispute to a court of competent jurisdiction in the place where the operating entity is located, or to bring litigation before an international arbitration institution otherwise agreed in writing by the parties. You agree to waive the right to participate in litigation in the form of any class action or representative action.
